Lindsay Lohan’s lawsuit against Take-Two and Rockstar Games in relation to the alleged unauthorised use of her “persona and image” in GTA 5 has not been dismissed as many onlookers believed would happen, The Hollywood Reporter writes.
Lohan alleges that Rockstar Games’ GTA 5 “used a look-alike model to evoke the persona and image” of Lohan by recreating a photo taken of her in 2007. The character Lacey Jonas is alleged to be based on Lohan. The game is even said to reference her role in Mean Girls and the West Hollywood hotel where she previously lived.
Take-Two had hoped to have the case dismissed for being “legally meritless” and Lohan’s claims having only been “filed for publicity purposes.”
Last week New York Supreme Court judge Joan Kennedy said that the lawsuit will continue as she can’t rely upon documents filed by the defendants with the intention of proving the images in question don’t feature Lohan. Kennedy also ruled that Lohan’s statements were sufficient to rule against Take-Two’s dismissal motion.
