A Japanese developer, FeiYingInfo, has successfully managed to get a blatant copyright infringement of Mario through Apple’s iOS certification process.
The game, listed only as 莫尼诺拯救总动员 and currently selling for 59p, features sprites and art culled from Nintendo’s flagship platforming series. The application icon itself is a duplicate of artwork used in 2007’s Super Paper Mario.
You don’t play as Mario, however – instead players take control of doppelganger Monino. FeiYingInfo’s app description sums up the plot: “The protagonist of this game named Monino, in the story of this game, Monino’s brother was captured by a monster named Bowler, he is on the road to Bowler’s castle to rescue his brother, a lot of monsters in different levels are waiting for him, would you like to join Monino’s rescue action? Go!”
Apple state that iOS developers should “ensure that [they] have the rights to all content used within you app, including code, icons, images, music, and the overall concept. If your content is questionable we will require proof of ownership.”
The game is currently 46th in the Apple’s ‘Top Paid’ chart.
