Activision has paid some of its employees $42 million, a sum owed for a delayed royalty payment for Modern Warfare 2, reports Polygon.

Bonuses were due to be paid after the release of Modern Warfare 2 in November 2009, but in 2010 a group of 38 development staff (the Infinity Ward Employee Group) were forced to sue Activision for unpaid royalties.

In addition, another separate case former studio directors Vince Zampella and Jason West sought various damages from Activision after the pair were fired for “insubordination”. This lawsuit continues.

The payment of $42 million has been paid after a review of the Zampella/West case by Activision’s legal team, which declared that various legal matters do not implicate the Infinity Ward Employee Group.

However, Bruce Isaacs, attorney for the Infinity Ward Employee Group, says this is not the end and more money is owned, calling the payment a “cynical attempt to look good before the [Zampella/West] jury trial.”

He added: “Although it is a meaningful payment it is only a small portion of what we are seeking in litigation.”

“It is outrageous that they made us wait, they obviously knew they owed the money and this just shows that they breached the contract.”

Back in 2010 the group of 38 claimed $125 million was owed.
