Sony starts legal proceedings against PSP Importers

Despite warnings from Sony to independent game retailers importing Japanese and American PSPs, it seems many indies are still selling import PSPs. Sony had issued Cease and Desist orders to a number of independent retailers, with ElectricBirdLand being the most vocal on the issue.

Sony has now taken things a step further and GamesIndustry has obtained a legal document put together by Sony’s lawyers. The document refers to a number of trademarks including “PS” and “PLAYSTATION”. The document says:

The defendant has infringed each of the claimant’s said trade marks by using, without the consent of the claimants, in the course of trade in the United Kingdom, signs identical to the said trade marks,” and goes on to say: “By reason of the aforesaid, the claimants have suffered loss and damage.

The document requests an inquiry into damages and wants the confiscation of goods and materials. Sony also seems to want the names and addresses of the suppliers of stock and those who purchased PSPs from the retailers. In the meantime, Sony has told retailers that they will be issuing an injunction to stop import PSPs from being sold.

With Sony now seemingly very serious about the import PSP matter it will be interesting to see how the retailers in question react. Dan Morelle, MD of ElectricBirdLand, had previously stated that he plans to defend his company’s actions in court.
