Judge is not inclined to delay Brutal Legend release

In June Activision sued Double Fine Productions and asked a judge to prevent EA from publishing the studio’s action video game Brutal Legend, claiming it owned the rights to the game and had invested nearly $15 million in its development.

On Thursday Los Angeles Superior Court Judge Craig Karlan said that he was inclined to deny Activision’s proposed motion, but would reschedule the formal ruling until August 6 to allow attorneys to fully argue their positions.

Double Fine is expected to deliver a final version of Brutal Legend to EA on August 8 and Judge Karlan has said the final ruling will be made so not to delay that any longer than necessary.

While admitting the decision was going to be a “close call”, Judge Karlan also told Activision attorneys that he can’t see “a likelihood of success”.
