EA being sued over no BF 1943 with PS3 Battlefield 3

PlayStation 3 fans were quite rightly annoyed by EA’s decision to back out of its plan to give buyers of the PlayStation 3 version of Battlefield 3 a free copy of Battlefield 1943, but EA might well suffer more than anger – the publisher is being sued.

Edelson McGuire has filed a class action suit against EA on behalf of displeased PlayStation 3 Battlefield 3 owners. It seems that the crux of the case revolves around EA’s late announcement of the offer change (now only being given the opportunity to buy DLC a week early) and the poor way this was communicated with fans – it revealed the change via Twitter.

Edelson McGuire claims EA “misled and profited from thousands of their customers by making a promise that they could not, and never intended, to keep”.

According to Kotaku, the parties involved simply want the copy of Battlefield 1943 they were promised.

Battlefield 3 entered the UK Video Game Chart at No.1 and has already shipped 10 million units worldwide.
