According to an Associated Press report, Activision is suing developer Double Fine Productions to prevent its game, Brutal Legend, from being released under the EA publishing label.

The lawsuit claims that Double Fine transferred publishing rights owned by Activision to Electronic Arts. According to the Associated Press report, Activision has invested roughly $15 million in Brutal Legend.

Brutal Legend is currently scheduled for release in October, 2009, for Xbox 360 and PS3.
