Bethesda sues Interplay

Kotaku reports that Bethesda Softworks has filed suit against Interplay, citing trademark infringement.

The complaint alleges that Interplay did not seek approval for the sale of the Fallout Trilogy bundle (Fallout, Fallout 2 and Fallout Tactics), and that the title, Fallout Trilogy, is similar to that of Fallout 3. Bethesda also has an issue with Interplay’s marketing, sale and distribution of other Fallout packages named Fallout Collection and Saga Fallout.

Bethesda’s complaint also cites Interplay’s licensing of Fallout games to digital distribution services Good Old Games (GOG), GameTap and Steam, which Interplay is said to have never sought permission for.

Bethesda isn’t stopping there, also wanting to terminate Interplay’s rights to create an MMO based on the Fallout license. The publisher believes Interplay has breached its trademark licensing agreement through not having entered into full-scale development of a Fallout MMO.

It looks like Bethesda doesn’t want Interplay to have anything to do with the Fallout brand.

Bethesda purchased the rights to the Fallout property from Interplay in 2007 for $5.75 million.
