Last week it emerged that unofficial Modern Warfare 3 site ModernWarfare3.com was redirecting visitors to the official Battlefield 3 site. It seems Activision isn’t overly pleased with this and has filed a complaint with the National Arbitration Forum.
The complaint describes the site redirection as retaliation for a take-down notice sent over copyrighted content that had appeared on the site. Activision has a number of avenues to pursue in order to gain control of the domain: prove that ModernWarfare3.com is identical or confusingly similar to its own trademarks, prove that the owner has no legitimate interests for use of the domain, or prove that the site is being used for commercial use – the latter seemingly already in the bag given that ads for GameStop and Best Buy have previously appeared.
Activision stated that it has spent more than $24 million in the US alone on marketing Modern Warfare titles.
Analyst Michael Pachter has already predicted that Call of Duty players may defect to Battlefield 3. In the grand scheme of things we doubt the efforts of ModernWarfare3.com will have much of an impact.
