Alan Stirling of Kemney Gardens, Dundee, pleaded guilty to culpable homicide to Edinburgh’s High Court after being accused of beating Paul McDonald to death. The incident happened on the 10th August 2006, when McDonald and a friend were staying at the accused’s flat after an evening watching football and drinking.
At some time between 4am and 5am, after McDonald had gone to sleep, Stirling was awoken by a crash. Upon investigating the noise it appeared McDonald had somehow knocked over the television, and an argument developed about damage to Stirling’s PlayStation, which quickly developed into a violent clash.
The 35-year-old father of three received a relatively short sentence, as there were indications he had tried to help his victim after the attack. Upon passing sentence Lord McPhail said, “The deceased was your good friend. It appears you became angry with him because he broke your PlayStation,” adding, “The fact remains your friend lost his life, his family has lost the deceased and in particular his little girl has lost a father and you are responsible.”
