Activision has reached a settlement over the game's release.
Attorneys for Activision notified the Los Angeles Superior Court on Wednesday that they had reached a settlement over the release of Brutal Legend.
The video game publisher had sued the game's developer, Double Fine Production, in an attempt to prevent the game from being released in October by EA, claiming it still owned the rights to the title.
Double Fine then counter sued, claiming Activision had terminated its agreement to release the game after it failed to make the game part of the Guitar Hero franchise.
Brutal Legend is scheduled for release on October 16 for Xbox 360 and PS3.
