Take Two Software, Inc. is under investigation by staff of the Federal Trade Commission's Division of Advertising Practices.

Take Two has released a press release stating that the company has been notified of an investigation by the FTC into advertising claims made for Grand Theft Auto: San Andreas. In the statement Take Two has said they will fully cooperate with the FTC inquiry and believe they acted in accordance with all applicable laws and regulations.

This investigation follows the recent ruling of the ESRB to revoke the game's M rating and award the sales-damaging Adults Only 18+ rating. In the statement the company explains how they regret that the sexual content had been made accessible.

"Rockstar Games and Take Two Interactive regret that consumers may have been exposed to content that was not intended to be accessible in the playable version of Grand Theft Auto: San Andreas."

Take Two also state how important the ESRB rating system is in preventing unsuitable game content being sold to minors.

"Take-Two Interactive recognizes and takes seriously its responsibility to ensure that its games are rated and marketed appropriately. The Company will continue to support and promote the ESRB rating system to help keep mature-themed video game content out of the hands of children."

A new version of GTA: San Andreas is to be released soon, with the sex mini-game removed and better protection against mods included.
