Gamasutra reports that Capcom and Nintendo have joined with 53 other unnamed video game publishers to file suit against four sellers of the R4 flash cartridge - a device which makes it possible to play pirated games on the Nintendo DS.

The suit seeks to prevent the distribution of the R4.

Last year, a Tokyo court issued an injunction to distributors of the R4, but according to Capcom this legal action had little effect, with vendors said to be ignoring warnings.

Capcom expects the court's ruling in the new lawsuit to show that itself and "other software manufactures have sustained [extreme] damages from proliferation of illegal instruments".
